Case closed in HC against Minister Vijay Shah, who made controversial statement on Colonel Sophia Qureshi

The Madhya Pradesh High Court has stopped the legal action taken by taking self -cognizance against the state’s Tribal Affairs Minister Vijay Shah after a controversial statement on Colonel Sophia Qureshi. On May 28, the Supreme Court had requested the MP High Court to stop taking action against the minister Vijay. On Monday, the couple of Justice Vivek Aggarwal and Justice AK Singh ended the case on the direction of the Supreme Court.

It is worth noting that the High Court took cognizance of the state government minister Vijay Shah on a public function in Raikunda village of Mhow-Ambedkar Nagar near Indore. In the order passed on 14 May, BNS against him till evening. Orders were issued to register an FIR under sections 152, 196 (1) (B) and 197 (1) (C). The couple had said in their order that the minister has used abusive language against a senior Indian Army officer. He has used the gutter language against Colonel Sophia Qureshi in the general meeting. His statement is prima facie the tendency to create disharmony and enmity or hatred or maliciousness among members of Muslim religion and other persons.

During the hearing on the petition on May 15 the next day, the High Court found that the FIR lodged against the minister did not mention the crime committed by him. The FIR is written with such content that can be canceled when challenged. The couple had said in their order that an FIR should be registered again, mentioning the description of the crime. The entire order to register an FIR by the High Court will be read as part of the paragraph 12 in all judicial, semi-judicial and investigation process. In view of the intention of the police, the High Court will monitor the investigation. However, the Supreme Court had requested the High Court in the case. The High Court has decided on that.
